Terms of use for the EU AI Act compliance document generation service under Regulation (EU) 2024/1689.

These Terms of Use govern the use of the EU AI Act Compliance Wizard service (hereinafter referred to as the "Service"), provided through the website cnts.bg/ai-act by CNTS Ltd (Centre for New Technology Systems), UIC 206255746, with registered office at: 44 Dunav St., fl. 3, 1202 Sofia, Bulgaria (hereinafter referred to as "CNTS" or "we").

By using the Service, you confirm that you have read, understood, and accept these terms in their entirety. If you do not agree with them, please do not use the Service.

1. Description of the Service

EU AI Act Compliance Wizard is a paid digital service for generating compliance documents under Regulation (EU) 2024/1689 of the European Parliament and of the Council (EU AI Act). The Service includes:

  • Risk assessment and AI system classification questionnaire
  • Compliance gap analysis
  • Recommendations for required documentation
  • Document templates in Bulgarian

The Service is intended for organizations that use or develop artificial intelligence systems falling within the scope of the EU AI Act.

The name "Compliance Wizard" refers to a tool that assists in the process of preparing compliance documentation, and does not constitute a guarantee of achieving regulatory compliance.

2. Important Notice - Limitations of the Service

CNTS Ltd is a technology company, not a law firm or legal consultancy. Use of this service does not create an attorney-client relationship or any other professional legal relationship.

The generated documents are working drafts and starting points, created with the assistance of AI (Anthropic Claude Opus). They:

  • DO NOT guarantee compliance with Regulation (EU) 2024/1689 (EU AI Act);
  • DO NOT replace consultation with a qualified lawyer;
  • May contain errors, omissions, or outdated information;
  • Must be reviewed and adapted by a qualified legal professional before use.

Potential consequences of reliance without legal review: Fines under Art. 99 of the EU AI Act can reach up to EUR 35,000,000 or 7% of global annual turnover. CNTS Ltd is not liable for regulatory sanctions, fines, or enforcement actions.

It is mandatory to seek qualified legal advice before using the generated documents for the purposes of regulatory compliance.

Use of the Service does not create a professional consulting, advisory, or fiduciary relationship between CNTS Ltd and the user. The generated documents are not protected by professional privilege (attorney-client privilege) within the meaning of the Bulgarian Bar Act.

3. Transparency Regarding the Use of AI (Art. 50 of the EU AI Act)

In accordance with the transparency requirements under Regulation (EU) 2024/1689, we inform you of the following:

  • AI model: The documents are generated using the Anthropic Claude (Opus) language model. All generated materials are the product of artificial intelligence processing.
  • Risk assessment: The risk classification combines deterministic rules (based on the regulatory annexes to the Regulation) with AI-based analysis of the user's specific context.
  • Document status: The generated documents are working drafts, intended as a starting point. They require mandatory review and adaptation by a qualified lawyer before use for regulatory compliance purposes.
  • No legal representation: CNTS does not provide legal advice and does not act as a legal representative of its users.
  • Classification of the service itself: The EU AI Act Wizard service itself constitutes an AI system within the meaning of Art. 3(1) of Regulation (EU) 2024/1689, classified as a limited-risk system (Title IV - transparency obligations). The Service does not fall within the category of high-risk AI systems under Annex III.
  • Justification: The Service does not fall within any of the categories of high-risk AI systems listed in Annex III of the Regulation. The Service does not make or assist in making decisions by public authorities, does not perform biometric identification, does not manage critical infrastructure, and does not evaluate natural persons. The generated documents are informational drafts without legal force.

4. Pricing Tiers and Payment

The Service is offered in three pricing tiers, determined by the risk level of the AI system:

  • Starter: €29 - for AI systems with minimal or limited risk
  • Standard: €49 - for AI systems with moderate risk and standard documentation requirements
  • Extended: €99 - for high-risk AI systems requiring a detailed draft documentation package under the Regulation

The names of the pricing tiers (Starter, Standard, Extended) reflect the volume of generated documentation and DO NOT constitute a regulatory classification of the user's AI system. Determining the risk level within the meaning of Regulation (EU) 2024/1689 is the responsibility of the user and should be confirmed by a qualified lawyer.

All prices are in euros and include applicable taxes. Payments are processed through the Stripe platform. CNTS does not store payment card data - it is processed entirely by Stripe in accordance with PCI DSS standards.

5. Right of Withdrawal (14-day period)

In accordance with Directive 2011/83/EU of the European Parliament and of the Council on consumer rights and Art. 50 of the Bulgarian Consumer Protection Act, you have the right to withdraw from the contract within 14 days from the date of purchase, without giving any reason.

Since the Service constitutes digital content that is delivered immediately after payment, by making the purchase you give your explicit consent to immediate performance and acknowledge that you lose your right of withdrawal once the documents have been generated.

Notwithstanding the above, as a gesture of goodwill, CNTS considers each case individually. If you are not satisfied with the Service, contact us at [email protected] within 14 days of purchase and we will do our best to find a satisfactory solution.

6. Access to Generated Documents

Upon successful payment, you receive access to the generated documents for a period of 6 months from the date of purchase. After this period expires, CNTS does not guarantee the preservation of the documents. We recommend that you download and save copies of the generated materials immediately upon receipt.

CNTS Ltd maintains backup copies of the generated documents. In the event of loss of access due to a technical issue, we will restore access within a reasonable timeframe. We recommend that users download and save a copy of the documents immediately after generation.

7. No Guarantee of Regulatory Compliance

The generated documents do not guarantee regulatory approval, compliance with the EU AI Act, or any other regulatory requirement. Specifically:

  • The documents reflect the state of Regulation (EU) 2024/1689 and the European Commission's guidelines as of the date of generation.
  • The EU AI Act is a new and evolving regulatory regime. Requirements, interpretations, and guidelines may change.
  • National competent authorities may introduce additional requirements that are not reflected in the generated documents.
  • Compliance depends on numerous factors specific to the particular organization and AI system, which cannot be fully addressed by an automated tool.

The European Commission has the power to adopt delegated acts under Art. 6(6) and Art. 7 of the Regulation, which may amend the list of high-risk AI systems in Annex III. Such changes may affect the classification of your AI system without being reflected in previously generated documents.

As of the date of provision of the Service, harmonised standards under Art. 40 of the Regulation have not yet been published for all categories of AI systems. The publication of such standards may significantly change the requirements for compliance documentation.

Reliance on the generated documents without independent legal review may result in: incorrect classification of the AI system, failure to meet mandatory documentation requirements, regulatory sanctions under Art. 99 of the Regulation, withdrawal of the AI system from the EU market, or loss of insurance coverage.

8. Accuracy of Content

CNTS makes reasonable efforts to ensure the accuracy and currency of the generated content. However:

  • The content is generated using an AI model that may contain inaccuracies, omissions, or outdated information.
  • The user bears full responsibility for verifying all generated documents before their use.
  • CNTS is not liable for errors, omissions, or inaccuracies in the generated content.

9. Intellectual Property

  • Generated documents: The user owns the rights to the specific documents generated for their organization. The user may freely use, modify, and distribute these documents for internal and regulatory purposes.
  • Platform and methodology: CNTS retains all intellectual property rights to the EU AI Act Compliance Wizard platform, including the software code, design, templates, risk assessment methodology, and all underlying algorithms.
  • Prohibition of reverse engineering: Decompiling, disassembling, or attempting to extract the source code, prompts, or methodology of the Service is prohibited.

10. Personal Data Protection

The processing of personal data in connection with the use of the Service is governed by our Privacy Policy. Data provided through the risk assessment questionnaire is used solely for the purpose of generating the documents and is not shared with third parties, except for processing through the Anthropic AI model necessary for content generation.

11. Limitation of Liability

To the maximum extent permitted by law, CNTS shall not be liable for:

  • Regulatory fines, sanctions, or enforcement actions imposed on the user by supervisory authorities.
  • Direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the Service.
  • Losses arising from decisions made on the basis of the generated documents.
  • Loss of data, lost profits, or business interruption.

The maximum aggregate liability of CNTS under these terms is limited to the amount paid by the user for the specific service.

This limitation of liability does not apply in cases of wilful misconduct or gross negligence on the part of CNTS Ltd and does not affect consumer rights under the Bulgarian Consumer Protection Act (CPA) and the mandatory provisions of Bulgarian law, including the statutory guarantee of conformity of digital content under Directive (EU) 2019/770.

This limitation of liability does not affect potential claims under Directive 85/374/EEC (Product Liability Directive), or Directive (EU) 2024/2853 upon its entry into force.

12. Updates and Changes

The EU AI Act is a new and evolving regulatory regime. The generated documents reflect the regulatory framework as of the date of their creation. CNTS:

  • Is not obligated to update previously generated documents upon changes in the regulatory framework.
  • Reserves the right to update the Service, pricing tiers, and these terms at any time.
  • Will notify users of material changes to the terms through the website or by email.

13. Applicable Law and Jurisdiction

These terms are governed by and construed in accordance with the laws of the Republic of Bulgaria. All disputes arising from or related to these terms shall be referred for resolution to the competent court in Sofia, Bulgaria.

For consumers residing in another EU Member State, the provisions of Regulation (EU) No 1215/2012 on jurisdiction shall apply.

16. Severability

If any provision of these terms is declared invalid by a competent court, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the original intent of the parties.

17. Entire Agreement

These Terms of Use, together with the Privacy Policy at cnts.bg/en/privacy, constitute the entire agreement between the user and CNTS Ltd regarding the Service.
